Berkot's Super Foods Grand Re-Opening Produce, Pork or Fried Chicken for a Year Sweepstakes Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES PERIOD: The Orland Park Berkot's Grand Re-Opening Produce Sweepstakes (the “Sweepstakes”) starts on Wednesday, May 3, 2017, at 7 a.m. Central Time and ends on Tuesday, June 6, 2017 at 10 p.m. CT (“Sweepstakes Period”). ELIGIBILITY: Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are at least 18 years of age. Employees, officers, directors, members, agents, and representatives of Berkot's Super Foods, Inc. (“Sponsor”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, officers, directors, members, agents, and representatives are not eligible to enter or win. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws. The information you provide will only be used for Sweepstakes administration.

HOW TO ENTER: Enter in-store: Locate a Sweepstakes Entry and Box at the Orland Park Berkot's and provide your name, telephone number and email address on the entry form within the timeframe of the Sweepstakes.

Entries must be received by Tuesday, June 6, 2017 at 10 p.m. CT to be eligible. Limit one (1) entry per person and per household each week of the Sweepstakes Period, resulting in maximum number of 5 entries. Entries received from any person or household in excess of the stated limitation will be considered void. All entries become the sole property of the Sponsor and will not be returned. Entries generated by mechanical means and entries made by any means which subvert the entry process will be void.

RANDOM DRAWING: One potential prize winner will be selected in a random drawing held on or about Wednesday, June 7, 2017, from among all eligible entries received for the drawing. Odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION: Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes. Potential winner will be notified by mail, phone, and/or email and he/she may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor, which must be returned within seven (7) days of date appearing on such prize notification. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact the potential winner within a reasonable time period or noncompliance with these Official Rules by the potential winner will result in disqualification and, at Sponsor’s sole discretion, prize may be awarded to an alternate. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. PRIZE (1 of each Produce, Pork or Fried Chicken): A “Produce for a Year”, "Pork for a Year", or "Fried Chicken for a Year" prize pack with $500 in Berkot's gift certificates. Approximate Retail Value (“ARV”): $500.

PRIZE CONDITIONS: Gift certificates are subject to certain terms and conditions specified by Sponsor. No substitutions, cash redemptions or transfers are permitted. Gift certificates are valid only in the U.S.A. for use at Berkot's locations. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute the prize (or portions thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.

GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Berkot's Super Foods and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion.

MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, illegible, delayed, misdirected, undelivered, entries or text messages, or for lost or stolen entry boxes, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prize, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised for any reason, including virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or portion thereof) and, if terminated, at its discretion, select the potential winner from among all non-suspect, eligible entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Illinois, USA. On January 24, 2017, Berkot's released the following statement regarding our Cage Free Egg Policy:

Berkot's Super Foods is a family owned and operated, community based grocery store working within the supply chain of Central Grocer. We have stores in 15 communities in Illinois and work hard to meet the needs and values of our customers. We also take pride in offering our customers a wide range of top quality products. Our goal is to adapt to our customer's needs and wants, offering the best choices whenever possible.

Recently, we have been contacted regarding our policy on cage-free eggs. The source of this inquiry is a national movement to encourage grocers to exclusively carry cage-free eggs. Berkot's Super Foods relies on Central Grocer which offers a wide variety of egg options including cage-free products. Based on demand and the egg industries adjustments, we expect egg options to increase over time. As these options increase and the supply of cage free product grows to meet the demand, we expect to move toward offering cage free eggs exclusively. In the meantime, we are continuing to remain committed to our customer's needs- affordability, variety, and quality.

Berkot's will continue to evaluate the egg industry and our customer's needs. We will continue to follow the lead of Central Grocers and work with our vendors and suppliers in their program to develop a sustainable and affordable cage-free egg supply. Berkot's believes in providing a high quality, humane and affordable option to meet our customers' growing demand. Animal welfare is evolving with customer expectations and Berkot's intends to meet those expectations. We are committed to developing a cage free egg solution. Information from Central Grocer, our research and current trends indicate results on or before the end of 2026.

On behalf of the Denis Savard Foundation, a second donation of $10,000 was made to Berkot's Ryan's Rescuers in support of JDRF. Hall of Famer and former Chicago Blackhawk, Denis Savard is a passionate supporter of JDRF and finding a cure for juvenile diabetes. His friendship and loyalty to Berkot's and its owners, the Kotara family, is greatly appreciated. In 2007, a member of the Kotara family, Ryan, was diagnosed with Type 1 diabetes. As a result, Berkot's supports JDRF and the search for a cure each year by hosting a charity golf outing and raising money in each of their 15 locations. #JDRF
Some parents spend the summer with their children at faraway vacation locations, while others stay closer to home and teach their kids about giving back. That’s what Jeff Schingel has done with his daughter, Bailee, for the past few summers. When she was only 9 years old, Bailee was diagnosed with acute myeloid leukemia (AML), a children’s cancer of the blood that starts in the bone marrow and spreads to the bloodstream. After she finished treatment and things were finally getting back to normal, Jeff said his family was looking for an organization to support to help pay forward all the support they had received. This summer, across fifteen Illinois-based Berkot's Super Foods locations, Jeff and his daughter Bailee raised $9,029.97 to support their team – Thumbs Down to Cancer – for the Chicago CureSearch Walk. Berkot's would like to send a BIG THANK YOU out to all that help out with the 2016 Chicago CureSearch donations at our store. From June 13th to July 10th donations were accepted at our checkout. GREAT JOB EVERYBODY!
Berkot's is proud to accept donations at registers in all of our locations for The St. Baldrick's Foundation. It is their mission to to fund research to conquer childhood cancers. To show support, a member of Berkot's staff has volunteered to shave her head on 3/19! St. Baldrick's takes great care with every donor dollar, keeping their staff small and their expenses low in order to direct every possible dollar to childhood cancer research. Berkot's is proud to donate a truckload of Absopure water to the people of Flint, MI. 1,512 cases (36,288 bottles) are on their way to help those in need. Flint's drinking water became contaminated after its source was switched from the nearby Detroit water system to the Flint River as a cost-saving measure in 2014. The untreated river water caused lead to leach from old pipes. We hope that the water situation in Flint improves, in the meantime, we hope that our contribution can help!

Our heart goes out to the residents of Flint, Michigan who are dealing with a city wide water contamination...

Berkot's is proud to collect donations for the Watseka, Illinois area flood victims. There has been wide spread damage and many have been evacuated from their homes. See the video link to view aerial shots of the flooding. https://youtu.be/Pr-KpyCmrUQ Watseka and it's surrounding communities saw flooding earlier this year and many haven't fully recovered from the loss and damage. The area is now flooding again and local charities need assistance. As a result, we are matching all donations up to a grand total of $10,000 to aid those in need. Berkot's is proud to be involved in our communities, finding ways to help those in need and supporting causes that do incredible things to improve and save lives. Last month, Berkot's made the commitment to aid the victims of the tornadoes in the Coal City area. We collected donations at our registers and matched those donations up to the $10,000 mark. When the drive was complete, we had collected over $33,000 from our generous customers and with our $10,000 donation we were able to donate over $43,000 to the Grundy County Disaster Relief Fund.

We now shift our focus over to a national charity that we support and believe in- Juvenile Diabetes Research Foundation. JDRF is the leading global organization focused on type 1 diabetes (T1D) research. Driven by passionate, grassroots volunteers connected to children, adolescents, and adults with this disease, JDRF is the largest charitable supporter of T1D research. Currently, all Berkot's locations have JDRF "sneakers" available at all registers for a donation to aid in the funding of this cause. We hope to have another successful campaign collaborating with JDRF to aid in the search for a working plan to better treat, prevent, and eventually cure T1D.
